Man faces felony OWI charge after arrest

Being charged with driving under the influence in Indianapolis can result in a series of penalties that can negatively affect a person's life for the long and short term. If the charges are substantial enough, they can rise to the level of felony OWI with the accompanying consequences. There are numerous circumstances that can result in a felony drunk driving charge and those who are placed under arrest in this situation should make sure they protect themselves with legal help from the start.

A 39-year-old man was arrested on allegations that he drove under the influence with five children in his car. Law enforcement began watching the man when his vehicle hit a curb at around 11:30 p.m. When the vehicle, a 2009 Chevy Traverse, stopped at a traffic signal, it did not move for a brief time when the light changed to green. A squad car turn on its lights to stop the Chevy, but it continued for about a mile before coming to stop.

As law enforcement investigated, they found five youths in the vehicle between the age of 2 and 16. The man was deemed to be intoxicated and was placed under arrest. A warrant was issued to draw blood to determine whether he had surpassed the legal limit for alcohol in the bloodstream or there were drugs in his system. Because there were juveniles in the vehicle at the time, the charges rise to felony drunk driving. He has multiple offenses lodged against him.

With the litany of penalties that can accompany a conviction for felony drunk driving, it is important for a person who was arrested on these charges to formulate a defense as soon as possible. It is possible that the investigation was flawed. Perhaps the police made the traffic stop without justification. The testing procedure could have been improper.
